Von den rund 588.000 Widersprüchen gegen Hartz-IV-Bescheide wurden 35,4 Prozent zugunsten der Betroffenen entschieden. Die traf auf sogar 43,3 Prozent der rund 115.000 Klagen gegen Jobcenter zu. Von den rund 59.000 Widersprüchen gegen Sanktionen, die die Kürzung der ohnehin viel zu geringen Hartz-IV-Leistungen bedeuten, wurden 37,6 Prozent zugunsten der Betroffenen entschieden, bei den rund 5.200 Klagen gegen Sanktionen waren in 43,9 Prozent der Klagefälle die Betroffenen erfolgreich. Das ergab die Antwort der Bundesregierung auf Anfrage von Katja Kipping. Dazu erklärt die Vorsitzende der Partei DIE LINKE:

Hartz IV ist nicht nur Armut und Ausgrenzung per Gesetz. Hartz IV befördert Behördenwillkür in beispiellosem Ausmaß - massenhafte Rechtsbeugung durch fehlerhafte Bescheide und rechtswidrige Sanktionen. Das Armuts-, Repressions- und Sanktionssystem Hartz IV gehört sofort abgeschafft. DIE LINKE wird ein Konzept einer sanktionsfreien, individuellen Mindestsicherung in Höhe von 1.050 Euro in den Bundestag einbringen.

Hartz IV ist und bleibt Armut per Gesetz, deshalb abschaffen

"Hartz IV hat den Niedriglohnsektor befördert, das Existenzminimum verfassungswidrig kleingerechnet und eine drastische Sanktionspraxis eingeführt. An dieser Realität kann sich die SPD als künftiges Mitglied einer großen Koalition nicht vorbeimogeln", erklärt die Vorsitzende der Partei DIE LINKE, Katja Kipping. Sie fordert, das Thema Hartz IV auf die Tagesordnung der Koalitionsverhandlungen zu setzen.

Bereits 2011 hat die SPD die Neuermittlung der Hartz-IV-Regelsätze nachdrücklich kritisiert. SPD-Generalsekretärin Andrea Nahles wurde mit der Aussage zitiert, dass der Regelsatz ?über 400 Euro liegen? müsse, alles andere sei künstlich herunter gerechnet. In der Opposition hat die SPD, zumindest der Forderung nach, einer Abschaffung des unverhältnismäßigen Sanktionsrechts für die Leistungsberechtigten bis 25 Jahre zugestimmt. In den Koalitionsverhandlungen kann die SPD nun zeigen, dass sie aus den Fehlern der Vergangenheit gelernt hat und sich aus dem Schatten von Schröder und Clement befreit. Ich fordere daher die SPD auf: Warten Sie nicht ab, bis das Bundesverfassungsgericht die Regelsätze erneut verwirft. Setzen Sie in den Koalitionsverhandlungen eine unabhängige Expertenkommission durch, die die Ermittlung der Regelsätze bei Hartz IV überprüft und korrigiert. Prüfen Sie ernsthaft, ob die Sanktionen dem Grundgesetz entsprechen. DIE LINKE streitet dafür, dass kurzfristig die Hartz-IV-Regelsätze auf 500 Euro erhöht und alle Sanktionen abgeschafft werden. Wir wollen ein Konzept für eine Mindestsicherung einbringen, die nicht mehr unter 1.050 Euro liegt.
