Im Dezember 2010 berichteten wir mehrfach über die rechtswidrige Praxis vieler Jobcenter, die Heizkosten bei Hartz IV um einen gewissen Anteil der Kosten für die Warmwassererzeugung zu kürzen. Mit seinem Urteil vom 15. Dezember 2010 hat das Bundessozialgericht Kassel (BSG, 15. Dezember 2010, Az. B 14 AS 61/09 R) diese Verfahrensweise rückwirkend zum 1 Januar 2006 untersagt. Viele betroffene Hartz-IV Bezieher haben daraufhin einen Überprüfungsantrag (§44 SGB X) bei ihrem Jobcenter gestellt und Recht bekommen.
