Hartz IV Regelsatz verfassungswidrig: Weg frei für Klärung vor dem Bundesverfassungsgericht

Einen ersten Durchbruch konnten Kläger vor dem Sozialgericht Berlin erreichen. Die Richter urteilten, dass der derzeit bemessene Hartz IV Regelsatz gegen die bundesdeutsche Verfassung verstößt. In dem heute veröffentlichten Urteil bescheinigten die Richter den Regelleistungen eine ''Verletzung des Grundrechts auf ein menschenwürdiges Existenzminimum''. Der Weg zum Bundesverfassungsgericht ist nunmehr geebnet, da die 55. Kammer ein Verfahren gegen das Jobcenter Berlin-Neukölln aussetzt und das Verfassungsgericht zur Prüfung anruft. Schwarz-Gelb und SPD droht verfassungsrechtlicher Schiffbruch bei Hartz-IV

Das Sozialgericht Berlin urteilte, dass die Hartz-IV-Regelbedarfe verfassungswidrig bestimmt worden seien. Insbesondere wird beklagt, dass die Auswahl der unteren 15 % der Alleinstehenden als Referenzgruppe zur Bestimmung der Regelbedarfe mit massiven Fehlern behaftet sei. Sie ist ohne nachvollziehbare Wertung und damit willkürlich erfolgt. Es sei nicht begründet worden, wie aus dem Ausgabeverhalten dieser Gruppe auf eine Bedarfsdeckung der Leistungsberechtigten geschlossen werden könne. Ebenso sei der wertende Ausschluss bestimmter Güter und Dienstleistungen aus dem Ausgabekatalog der Einkommens- und Verbrauchsstichprobe 2008 nicht nachvollziehbar begründet. Der Gesetzgeber verkenne insbesondere, dass das Existenzminimum auch die Pflege zwischenmenschlicher Beziehungen zu ermöglichen habe. Im Übrigen wäre bei einem derart ''auf Kante genähten'' Regelbedarf das Statistikmodell seiner Legitimation beraubt. Zu diesem Urteil des Berliner Sozialgerichts erklärt die stellvertretende Vorsitzende der Partei DIE LINKE, Katja Kipping:

Viele grundsätzliche Kritikpunkte des Sozialgerichts hat die LINKE während der Gesetzgebung zu den neuen Regelbedarfen immer wieder vorgetragen. Nun haben Sozialrichter diese Kritiken bestätigt. CDU/CSU, FDP und SPD, die diesen Regelbedarfen zugestimmt haben, sollten sich schämen. Schwarz-Gelb und SPD droht mit der ignoranten Bestimmung der Regelbedarfe verfassungsrechtlicher Schiffbruch. Und das zu Recht. Aber nicht Häme ist angesagt. Wir brauchen endlich eine breite gesellschaftliche Diskussion darüber, was zum guten Leben für alle gehört, und wie Transfersysteme so ausgestaltet werden können, dass das Grundrecht auf ein menschenwürdiges Leben garantiert ist. DIE LINKE ist bereit, diese Debatte zu führen.

Generalrevision von Hartz IV muss auf die Tagesordnung

Der Vorsitzende der LINKEN, Klaus Ernst, verlangt angesichts des Berliner Hartz IV-Urteils und der koalitionsinternen Debatten um einen gesetzlichen Mindestlohn eine ''Generalrevision von Hartz IV''. Kernelemente einer Reform müssen nach Ernsts Ansicht die Festsetzung eines verfassungsgemäßen Regelsatzes und die Einführung eines gesetzlichen Mindestlohns sein. Ernst erklärt:

Das Berliner Hartz-IV-Urteil ist ein Meilenstein und eine Ohrfeige für die ganz große Koalition, die vor einem Jahr sehenden Auges einen verfassungswidrigen Regelsatz beschlossen hat. Das Berliner Sozialgericht hat wegen der fortgesetzten Arbeitsverweigerung der Politik erstmals eine Zahl für den Regelsatz errechnet. Hinter die 410 Euro des Berliner Urteils kann nun auch die Bundesregierung nicht mehr zurück. Das ist gut so, auch wenn 410 Euro immer noch zu wenig sind, um den Anforderungen des Grundgesetzes zu genügen. Der nächste Schritt ist deshalb eine Generalrevision von Hartz IV. Kernelemente der Reform müssen die Festsetzung eines verfassungsgemäßen Regelsatzes und die Einführung eines gesetzlichen Mindestlohns sein, der sicherstellt, dass wer Vollzeit arbeitet, davon würdig und ohne ergänzende Sozialhilfe leben kann. Die Politik hat versagt. Ich bin dafür, dass wir die Vorbereitung so einer Reform einer unabhängigen Kommission übertragen, in der Experten aus Wissenschaft, Sozialverbänden, Gewerkschaften und Erwerbsloseninitiativen übertragen. Das Parlament muss jetzt die Scharte der missglückten Von-der-Leyen-Reform schnell auswetzen.

Stadt Frankfurt entlarvt sich selbst: Grundgesetz außer Kraft gesetzt

''Das Ordnungsamt der Stadt Frankfurt bestätigt nun selbst die generelle Außerkraftsetzung des Grundrechts auf Versammlungsfreiheit. Die vom Komitee für Grundrechte und Demokratie angemeldete Kundgebung, am Donnerstag, 17. Mai 2012, von 12.00 bis 18.00 Uhr wurde Dienstag, 15. Mai 2012, mittags verboten. Zur Begründung führt das Ordnungsamt an, dass das Grundrechtekomitee in einem offenen Brief an Frau Oberbürgermeisterin Roth appelliert hat, das Verbot der Versammlungen (von Blockupy) umgehend aufzuheben. Ansonsten wird pauschal die Verbotsbegründung, mit der die Versammlungen von Blockupy verboten wurden, genutzt. Chicago: Massenproteste und Hochspannung vor Nato-Gipfel

''Chicago rüstet sich für weitere massive Proteste zum Höhepunkt des Nato-Gipfels. Die Sicherheitslage spitzt sich zu. Bereits vor dem Beginn des streng abgeschirmten Spitzentreffens zogen Tausende Demonstranten durch die Straßen der Millionenmetropole. Damit zusammenhängt, dass es erkennbar schwierig ist, die Krisenproteste mit aktuellen sozialen Kämpfen zu verbinden. So ist in den letzten Wochen wieder viel von einer Schließung des Opelwerks in Bochum die Rede. Dort gibt es eine kämpferische Minderheit in der Belegschaft, die schon vor Jahren mit selbstorganisierten Streiks auf sich aufmerksam gemacht hat. Trotzdem war die drohende Schließung von Opel-Bochum auf der Demonstration genauso wenig ein Thema wie die Abwicklung vieler Schlecker- Filialen in den letzten Wochen. Dabei hat die Berliner Schlecker-Gesamtbetriebsrätin Mona Frias einen gewerkschaftlichen Unterstützungsaufruf für Blockupy mit unterzeichnet. Doch es sind weder in erster Linie abschreckende Maßnahmen der Polizei noch große Fehler der Protestorganisatoren, die verhindern, dass Opel- oder Schlecker-Beschäftigte sich massenhaft an den Blockupy-Protesten beteiligen. Die Ungleichzeitigkeit der Krisenpolitik und der Wahrnehmung bei den Betroffenen erschwert einen gemeinsamen Widerstand...?

So werden die Ängste vor Verarmung für eine Politik der Verarmung mobilisiert, die doch längst begonnen hat. Dass die (noch) gute Wirtschaftslage Deutschlands parteiübergreifend mit Niedriglohnpolitik erkauft wurde, sprechen Merkel und Freunde natürlich nicht aus. Dass das Spardiktat die Kaufkraft eben jener Märkte zerstört, von denen deutsche Exporte profitierten, verschweigen sie auch. Und die Niedriglöhner, die Dauerpraktikanten, die prekär Beschäftigten, sie halten mehrheitlich still, weil es ja noch schlimmer werden könnte. Damit genau das so bleibt, wurde in Frankfurt ein Exempel statuiert. Als eigentliche Bedrohung für ein auskömmliches und ungestörtes Leben der Menschen sollten nicht diejenigen Institutionen dastehen, die es gefährden. Die eigentliche Gefahr, das wollte die exzessive Frankfurter Verbotspolitik sagen, gehe von denjenigen aus, die sich dagegen wehren und Alternativen fordern?''
