Bundessozialgericht kippt Duisburger Mietobergrenze

Das Bundessozialgericht hat in der Verhandlung vom 20. Dezember 11 eine interessante Entscheidung getroffen. Es ging hierbei um das 'schlüssige Konzept' der Stadt Duisburg, welches von Sozialgericht Duisburg und dem Landessozialgericht für rechtens gehalten wurde. Diese Entscheidungen wurden nun aufgehoben. Die Vorsinstanzen hatten bestimmte Baualtersklassen aus dem Mietspiegel nicht einbezogen, obwohl nicht fest stand, dass aus diesen Altersklassen wenige Wohnungen zum unteren Marktsegment gehören...
