So says a New York Times editorial opposing capital punishment in the wake of Troy Davis' execution in Georgia late last month. Those are strong words from the Grey Lady, and I couldn t agree more. Many have demonstrated convincingly that Troy Davis' trial and prosecution were riddled with racism, error and possibly even prosecutorial misconduct. The American justice system failed Mr. Davis with tragic, irreparable results - and the Supreme Court wouldn t step in to remedy the injustice, in part because he had been granted full due process under the law. Anti-Terror-Gesetz: Warnung vor neuer Geheimpolizei

'Der Berliner Verfassungsrechtler Martin Kutscha hat große Zweifel daran, dass der Regierungsentwurf zur Verlängerung von Befugnissen aus dem Terrorismusbekämpfungsergänzungsgesetz (TBEG) mit dem Grundgesetz vereinbar ist. Vor allem die geplante Auskunftspflicht, wonach privaten Stellen wie Banken, Telekommunikationsunternehmen, Anbieter von Telediensten oder Fluggesellschaften künftig Informationen über Verdächtige unverzüglich, vollständig, richtig und in geeignetem Datenformat an den Verfassungsschutz und andere Geheimdienste herausgeben müssten, kollidiere mit dem sogenannten Trennungsgebot, warnte der Jurist bei einer Anhörung (PDF-Datei) im Innenausschuss des Bundestags am Montag. Rechtsfreier Raum Polizei? Wie Standardfloskeln ad absurdum geführt werden

Wird dagegen ein Fall von Polizeigewalt bekannt (Polizeigewalt = Gewalt durch Polizisten, nicht Gewalt gegen Polizisten), so wird eben diese Argumentation nicht angewandt, vielmehr wird vor Pauschalverurteilungen gewarnt und auf Einzelfälle verwiesen. Dabei sind derlei Vorfälle nicht nur sporadisch auftauchende, exotische Meldungen, sondern häufen sich in den letzten Jahren. Würde man die Argumentation der (Schein)sicherhetisapologeten konsequent anwenden, so müsste schon der erste Fall von Polizeigewalt zu Rufen nach mehr interner Kontrolle, konsequenter Überwachung von Polizeieinsätzen sowie der Speicherung der entsprechenden Daten auf Vorrat führen. 'Wer nichts zu verbergen hat, hat auch nichts zu befürchten' lautet die oft genug wiederholte Standardargumentation, wann immer es gilt, Kritiker von Überwachung und Datensammlung ins Abseits zu rücken. Diese bereits hinreichend analysierte Phrase spielt jedoch bei der Auseinandersetzung um Polizeigewalt sowie deren Aufklärung keine Rolle. Gerade auch, wenn es um die Identifikationsmöglichkeiten geht, wird, völlig konträr zu den sonstigen Argumentationslinien, die Privatsphäre und die Gefahr, die mit dem Verlust der informationellen Selbstbestimmung einhergeht, hochgehalten?'
