Die Richtlinie des Rates über die nukleare Sicherheit kerntechnischer Anlagen in der EU von 2009 ist schnellstmöglich unter Mitentscheidung des EU-Parlaments zu novellieren. Ich fordere ein europaweites Ausstiegsszenario und die Auflösung des EURATOM-Vertrages. Beim Schutz vor radioaktiver Verstrahlung müssen Parlamente und die Menschen in Europa mitentscheiden dürfen.

Klage gegen den neuen 364-Euro-Regelsatz

'In der letzten Aprilwoche wurde eine von uns unterstützte Eilklage gegen den fehlerhaft ermittelten und zu geringen Regelsatz von 364 Euro beim Sozialgericht eingereicht,' teilt Hartz4-Plattform Sprecherin Brigitte Vallenthin mit. 'Unsere Bürgerinitiative dankt Dr. Ulrich Sartorius, Lehrbeauftragter an der Universität Freiburg und langjähriger Dozent bei der Deutschen Anwalt Akademie, für seine Unterstützung bei diesem Verfahren.

Damit wollen wir im Interesse aller Betroffenen den schnellst möglichen Rechtsweg beschreiten, damit das Bundesverfassungsgericht (BVerfG) die Politik an ihre Hausaufgaben aus dem Hartz IV-Urteil vom 9. Februar 2010 erinnert und nach dessen Buchstaben ein tatsächliches Grundrecht auf 'menschenwürdiges Existenzminimum' sicher stellt.?

Der für einen von der Hartz4-Plattform unterstützten Kläger eingereichte Antrag auf einstweilige Anordnung fußt auf erheblichen Bedenken, die bereits im Gesetzgebungsverfahren geltend gemacht wurden und verweist auf die Ausschussdrucksache des Ausschuss für Arbeit und Soziales vom 16.11.2010, 17 (11) 309 sowie verfassungsrechtliche Einwendungen von Münder, Prof. Dr. jur. Johannes Münder, Technische Universität Berlin.

Der Schriftsatz beruht auf einem von Anwältinnen und Anwälten der Arbeitsgemeinschaft Sozialrecht im Deutschen Anwaltverein (DAV) erstellten Musterschriftsatz, der mit weiteren Musterschriftsätzen zum SGB II demnächst veröffentlicht wird. Deren Inhalte stehen dann den mehr als 1.000 Anwältinnen und Anwälten zur Verfügung, die Mitglieder der DAV-Arbeitsgemeinschaft Sozialrecht sind.

Tenor der Klage ist:

'Die Ermittlung und Festlegung des Regelbedarfs entspricht nicht den Anforderungen, die das BVerfG dem Gesetzgeber aufgegeben hat.' Ihnen 'genügen die Neuregelungen in mehrfacher Hinsicht nicht.'

Hartz IV: Besondere Freude über Sanktionen?

Mittlerweile dürfte es sich herum gesprochen haben, dass Mitarbeiter der Jobcenter Vorgaben erhalten, die unter anderem eine 'Sanktionsqoute' vorgeben. Viele Mitarbeiter in den Hartz IV Behörden betonen, sie würden solche Anweisungen im Arbeitsalltag beachten, andere wiederum macht es anscheinend regelrecht Spaß, für ihren vorgesetzten Dienstherrn Gelder einzusparen. Genanntes Beispiel des Runden Tisches gegen Erwerbslosigkeit und soziale Ausgrenzung in Berlin ist zwar rein fiktiv, könnte sich aber nach Erzählungen einiger ehemaligen Behördenmitarbeiter genauso täglich abspielen. Aus der Hartz IV Praxis

Ich lebe in einer Kleinstadt im südlichen NRW, hier kennt man sich, im Ortskern leben ca. 8000 Menschen. Für mich sind Hartz IV und Sozialhilfe jeden Tag zum 'Greifen' nahe, bei uns leben ca. 12 Prozent der Bevölkerung von dem ihnen als 'Existenzminimum' zugestandenen Leistungen, von denen selbst der Vizepräsident der Bundesanstalt für Arbeit in einem Interview mit der Zeitung "Der Tagesspiegel" am 29. Brutto-Kaltmiete muss bei Hartz IV angemessen sein

In dem Urteil vom 6 April 11 (S 41 AS 3047/10) hat das Sozialgericht Duisburg für die Stadt Essen einen anderen Berechnungsmodus für die Bedarfe der Unterkunft angewendet, als dieses vom Jobcenter selbst seit 2005 geschieht. Während das Jobcenter nur die Netto-Kaltmiete oder auch Grundmiete genannt auf ihre Angemessenheit kontrolliert, ist nach dem SG-Urteil die Summe von Grundmiete und Nebenkosten entscheidend. Der 3. Mai ist seit 17 Jahren der Internationale Tag der Pressefreiheit.

Er ist heute notwendiger denn je, die Bilanzen, die verschiedene Journalistenorganisationen weltweit aus diesem Anlass vorlegen, sprechen eine beredte Sprache. (?) Die dju in ver.di steht fest und solidarisch an der Seite ihrer Kolleginnen und Kollegen in allen Ländern, in denen die Pressefreiheit unter Druck geraten oder ausgehebelt ist. In direkter Aktion oder gemeinsam mit unseren internationalen Organisationen wie die Internationale Journalisten-Föderation (IJF), das International News Safety Institute (INSI) oder Reporter ohne Grenzen (ROG) machen wir Verstöße gegen die Pressefreiheit öffentlich, benennen die Akteure, unterstützen wir bedrohte und verfolgte Kolleginnen und Kollegen. Pressefreiheit ernst gemeint

Das Papier unter dem Titel 'Maßnahmenpaket Personal-Qualität' ist nach SPIEGEL-Informationen 20 Seiten lang und sammelt die Namen von Dutzenden ebenso langjährigen wie missliebigen Angestellten im gesamten Bundesgebiet. Manche waren im Betriebsrat, fast alle hatten hohe Gehaltsstufen erreicht und waren entsprechend teuer geworden. Diese Beschäftigten würden 'in der Optik stehen', heißt es in der Mail einer Managerin. Gemeint ist wohl: Die Namen auf Strisciullis Liste stehen unter verschärfter Beobachtung. Neben vielen Namen finden sich auf der Liste zwei Zahlen: Das eine Datum markiert nach Meinung von Betriebsräten den Zeitpunkt, als die Mitarbeiter auf der Liste ins Fadenkreuz der Schlecker-Führung gerieten.
