EHS/EMR lawsuits

Hi Klaus: This is the second part of my submission to Mr. Des Hogan,
Senior Caseworker, Irish Human Rights Commission.

Of course additions to this list are very welcome.

In response to your second query regards court decisions in other
jurisdictions based on EHS litigation, I have information on ongoing
court proceedings but not of final decisions.

* The John Hughes Law Practice, U.K. is suing a telecommunication
company on behalf of residents of Wishaw, Sutton Coldfield. As you can
see in copy of the enclosed action adverse bioeffects from this specific
EMR source is the chief reason for the lawsuit.

* Class action suits are in progress in Israel based in part on adverse
health attributable to specific EMR emitting sources.

* A case taken by Jesus Mendoza Maldonado, Texas, based on the extreme
EHS he and his two children are suffering from "a discrim-inatory and
retaliatory abuse of Active Electronic Surveillance." Being targeted by
EMR for covert harassment is becoming quite common and can cause serious
health injuries as well as causing the victim to become very EHS.

You might also like to read my account of a week of e-harassment I

* A number of big cases based on brain cancer caused by cellphones
and/or masts are ongoing, esp. in the U.S. Dr. Christopher Newman's case
is an £800 million action against Motorola.

* From copies of affidavits I have read I am aware that there must be or
have been other EHS persons who took court action on this issue. For
instance, Dr. Gunnar Heuser, Ass. Clinical Prof. of Medicine at U.C.L.A.
has stated in an affidavit of 11/6/98 that "As a clinician, I can state
that electrical sensitivity is a real medical disease. My more than
twenty electrically sensitive patients and all other electrically
sensitive patients are in urgent need of relief. Exposure to any radio
frequency radiation should be avoided in these patients."

* The EHS person whose bio account is entered in the CIO posting of
15/9/02 may be taking legal action. I have written to find out but
haven't had a reply as yet. Her EHS condition got even worse during her
incarceration because she was exposed to flourescent lights, heavy
hospital EMR emissions, etc.

While you did not ask me for cases of litigation in Ireland based on
the EHS issue, it might be helpful if I mentioned two that I am aware
of. I do not know how active these cases are. The first is being taken
by Lavelle Coleman Solicitors, 51-52 Fitzwilliam Square, Dublin and the
solicitor involved is Brian Bailey. He is taking a case based on EHS for
---[name omitted here]. The second contemplated case is by Chris O'Shea
of Donal T. Ryan and Co., Solicitors, Cahir, Co. Tipperary. I am
enclosing copies of my brief correspondance with Mr. O'Shea as it is not
marked confidential.

I would also like to direct you again to what I have written and is
posted online at CIO 19/9/02 ("EMF and schizophrenia") about how
difficult it is to get any justice for persons suffering from EHS. They
are so often just not believed because many doctors are not as yet aware
of the condition and so the poor patients are told its all in the head!
And in the cruellest instances are shooed off--or tricked into
--psychiatric facilities and stamped with a wrong diagnosis makes them
social outcasts and professional failures for life! There really is
nothing worse that could happen a person in life than to be misdiagnosed
as psychotic/paranoid schizophrenic. . . ..

Social Security Administration, Administrative Law Judge, Edward
